Terms of Use

Wearlist is a product and service operated by Neidbau, LLC ("Neidbau," "we," "us," or "our"). These Terms of Use ("Terms") govern your use of the Wearlist mobile application, wearlist.app, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use Wearlist.

1. Eligibility

You must be at least 13 years old to use Wearlist. If the laws in your country or region require a higher minimum age or parental consent, you may use Wearlist only after meeting those requirements.

2. The Service

Wearlist lets you:

• Add and organize pieces in a digital closet
• Create and save outfits
• Plan outfits on a calendar
• Generate AI-powered virtual try-on images

We may update, change, suspend, or discontinue features. We do not guarantee that every feature will always be available on every device or in every region.

3. Your Account

You are responsible for the accuracy of your account information, the security of your sign-in method, and activity under your account. Notify us promptly if you believe your account has been accessed without permission.

4. User Content

"User Content" includes photos, images, text, outfit compositions, and other content you upload, create, or generate through Wearlist.

Your ownership: You retain your rights in User Content. You must have the necessary rights and permissions to upload and process it, including permission from any person shown in a photo.

Limited license: You grant Neidbau, LLC a limited, non-exclusive license to host, store, reproduce, process, transmit, and display User Content only as reasonably necessary to operate and provide the Service. This includes sending selected images to service providers for background removal and AI Try-On processing.

You must not upload content that is unlawful, harmful, deceptive, or infringes another person's privacy, publicity, intellectual property, or other rights.

5. Acceptable Use

You must not:

• Use the Service in violation of applicable law
• Use another person's image without permission
• Attempt to access another user's account or data
• Abuse, disrupt, scrape, or reverse engineer the Service
• Bypass usage limits, security controls, or rate limits
• Use the Service to create illegal or harmful content

We may restrict or suspend access when reasonably necessary to protect users, providers, or the Service, or when these Terms are materially violated.

6. Subscriptions, Purchases, and Credits

Wearlist may offer free features, Pro subscriptions, and consumable AI credit packs. Current features, limits, products, and prices are shown in the App and the relevant app store.

• Payments and refunds are processed by Apple or Google under their applicable terms and policies.
• Subscriptions automatically renew unless canceled through the relevant store before renewal.
• Canceling a subscription stops future renewal but does not delete your Wearlist account.
• Deleting your Wearlist account does not cancel an active store subscription.
• AI credits have no cash value, are non-transferable, and are available only through the account to which they are credited.
• Deleting an account permanently removes its remaining AI credit balance.

7. AI Features

AI Try-On results are generated visualizations for personal inspiration. Results may be inaccurate, incomplete, unrealistic, or different from how clothing appears in real life. Do not rely on AI results for sizing, fit, purchasing, health, or other consequential decisions.

AI feature availability and quality may vary based on input images, selected pieces, provider availability, usage limits, and other technical factors.

8. Wearlist Intellectual Property

The Service, Wearlist brand, software, designs, and content provided by Neidbau, LLC, excluding User Content, are protected by intellectual property laws. These Terms do not grant you ownership of them.

9. Account Deletion and Termination

You may delete your account through the App or request deletion at wearlist.app/account-deletion. Account deletion is permanent and cannot be undone. More information is available in our Privacy Policy.

We may suspend or terminate access when reasonably necessary to comply with law, protect the Service or its users, address fraud or abuse, or respond to a material violation of these Terms. Where appropriate, we will provide notice or an opportunity to address the issue.

10. Disclaimers

To the extent permitted by applicable law, the Service is provided "as is" and "as available." We do not guarantee uninterrupted availability, error-free operation, preservation of all data, or the accuracy or quality of AI-generated results.

11. Limitation of Liability

To the extent permitted by applicable law, Neidbau, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or opportunities arising from your use of the Service. Neidbau, LLC's aggregate liability relating to the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

12. Applicable Law and Consumer Rights

These Terms are governed by applicable laws. Nothing in these Terms limits any mandatory consumer rights available to you under the laws of your country or region.

13. Changes to These Terms

We may update these Terms as the Service changes. We will update the date above and provide additional notice when required by applicable law. If you do not agree to updated Terms, you should stop using the Service and may delete your account.

14. Severability

If any part of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
